1. WHO WE ARE
Build or Die is a brand operated by Smith Catalyst Ventures, LLC, a Wyoming limited liability company ("Smith Catalyst Ventures," "Build or Die," "we," "us," or "our"). This Privacy Policy explains how we collect, use, disclose, and protect personal information through buildordie.co, our newsletters, podcasts, communities, digital products, events, and related services (collectively, the "Services").

2. SCOPE
This Policy applies to information we collect online and offline in connection with Build or Die. It does not apply to third-party websites, platforms, or services we link to, or to the separate services of our affiliated brands where those services publish their own privacy notices.
3. INFORMATION WE COLLECT

3.2 Information collected automatically
Device identifiers, browser type and version, operating system, referring and exit URLs, pages viewed, time on page, clickstream data, approximate geolocation derived from IP address, and cookie, pixel, and advertising identifiers.
3.3 Information from third parties
Analytics providers, advertising platforms, email and SMS service providers, payment processors, event and webinar platforms, and publicly available sources.
3.4 Sensitive personal information
We do not intentionally collect Social Security numbers, government ID numbers, precise geolocation, biometric data, racial or ethnic origin, religious beliefs, union membership, genetic data, sexual orientation, or health information through the Services. Please do not submit health information or protected health information to Build or Die. If you do, we will handle it under this Policy but ask that you refrain.
4. HOW WE USE INFORMATION
We use personal information to:
Provide, operate, and maintain the Services
Process transactions and deliver purchased products, programs, and content
Send transactional and account communications
Send marketing and promotional communications where you have consented or where permitted by law
Personalize content and recommendations
Measure and improve the performance of our content, offers, and advertising, including through analytics and advertising platforms
Deliver and measure targeted advertising on third-party platforms
Conduct analytics and research
Prevent fraud, abuse, and security incidents
Establish, exercise, or defend legal claims and comply with legal obligations
Legal bases (where GDPR/UK GDPR applies): performance of a contract; your consent; our legitimate interests in operating and improving our business; and compliance with legal obligations.
5. MOBILE INFORMATION AND SMS — SPECIFIC COMMITMENT
No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties, excluding aggregators and providers of the text messaging services who assist us in delivering the messages you requested.
This commitment applies to your mobile number and SMS consent regardless of any other disclosure described in this Policy, including the advertising disclosures in Sections 6 and 8. We do not upload mobile numbers collected through our SMS opt-in to advertising platforms for audience matching or targeting.
SMS consent you give to Build or Die applies only to Build or Die. It is not transferred to our affiliated brands. Our full messaging terms are at buildordie.co/sms-terms.
6. HOW WE DISCLOSE INFORMATION
We disclose personal information to:
Service providers and processors — hosting, email and SMS platforms, CRM, payment processing, analytics, customer support, scheduling, and course and community platforms, in each case bound by contract to use the information only for our purposes
Advertising and analytics partners — including advertising platforms that place cookies, pixels, and similar technologies on our website for measurement and targeted advertising. See Section 8.
Professional advisors — attorneys, accountants, auditors, and insurers
Business transfers — in connection with a merger, acquisition, financing, or sale of assets
Legal and safety — where required by law, subpoena, or court order, or to protect our rights, property, or the safety of any person
We do not sell personal information for money. However, our use of advertising and analytics cookies and pixels may constitute "sharing" for cross-context behavioral advertising under California law, and a "sale" or processing for "targeted advertising" under the privacy laws of other states. You have the right to opt out. See Sections 8 and 9.
We do not sell or share personal information of consumers we know to be under 16 years of age.
7. RETENTION
We retain personal information for as long as needed for the purposes described above, and thereafter as required to comply with legal obligations, resolve disputes, and enforce agreements. Specifically:
Marketing and SMS consent records: at least 5 years after the consent is given or withdrawn
Opt-out and revocation records: at least 10 years
Transaction records: as required by applicable tax and commercial law
Inactive accounts: 36 months after last activity, unless a longer period is required
8. COOKIES, PIXELS, AND ADVERTISING
We use cookies, pixels, tags, SDKs, and similar technologies for essential site functionality, analytics, and advertising. This includes advertising and measurement technologies operated by third-party platforms, which may receive information about your visit — such as pages viewed, actions taken, and identifiers — and may use it to show you advertising for Build or Die on their platforms and elsewhere.
How to opt out of targeted advertising:
Global Privacy Control. We honor the Global Privacy Control (GPC) and other recognized opt-out preference signals as valid requests to opt out of sale, sharing, and targeted advertising. Enabling GPC in a supported browser or extension will apply automatically.
Our opt-out mechanism. Use the "Do Not Sell or Share My Personal Information" link in our website footer, or email [email protected].
Browser and platform controls. Adjust your browser cookie settings, and use the ad-preference controls offered by the individual advertising platforms.
Opting out will not stop you from seeing advertising generally; it stops the use of your information for cross-context behavioral advertising by us.
Do Not Track. We do not currently respond to browser Do Not Track signals, as no common standard has been adopted. We do honor GPC as described above.
9. YOUR PRIVACY RIGHTS
9.1 All users. You may unsubscribe from marketing email using the link in any email, and from SMS by replying STOP. You may contact us at [email protected] to request access to, correction of, or deletion of your information, and we will honor the request to the extent required by applicable law.
9.2 U.S. state privacy rights. Depending on your state of residence, you may have the right to:
Know / access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties to whom we disclose it
Delete personal information we have collected from you
Correct inaccurate personal information
Portability — obtain a copy in a portable, readily usable format
Opt out of the sale of personal information, sharing for cross-context behavioral advertising, targeted advertising, and profiling in furtherance of decisions producing legal or similarly significant effects
Limit use and disclosure of sensitive personal information
Non-discrimination for exercising these rights
Appeal a denial of your request, where your state provides an appeal right
These rights are available in varying forms to residents of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, Rhode Island, and Florida, among others. We apply these rights consistently to all U.S. residents as a matter of practice.
9.3 How to exercise. Email your request to [email protected] with the subject line "Privacy Request." We will verify your identity using information already in our possession. You may use an authorized agent where your state permits; we may require proof of authorization. We respond within 45 days, extendable by an additional 45 days where permitted, and will explain any denial. If we deny your request, you may appeal by replying to our response with the subject line "Privacy Appeal."
9.4 California. In the preceding 12 months we collected the categories of personal information listed in Section 3 for the purposes in Section 4, disclosed them to the categories of recipients in Section 6, and shared identifiers and internet activity information for cross-context behavioral advertising as described in Section 8. California residents may also request information under California's "Shine the Light" law (Civ. Code § 1798.83) by contacting [email protected].
9.5 Nevada. Nevada residents may submit a verified request to opt out of the sale of covered information to [email protected].
9.6 Washington, Nevada, and Connecticut consumer health data. We do not intend to collect "consumer health data" as defined by the Washington My Health My Data Act, the Nevada Consumer Health Data Privacy Act, or the Connecticut Data Privacy Act. Please do not submit health information through the Services. If you believe we hold consumer health data about you, contact [email protected] to request deletion.
9.7 EEA/UK/Swiss residents. You may have rights of access, rectification, erasure, restriction, objection, portability, and withdrawal of consent, and the right to lodge a complaint with your supervisory authority. Where we transfer data outside your region, we rely on appropriate safeguards including Standard Contractual Clauses.
10. CHILDREN'S PRIVACY
The Services are intended for adults engaged in business and professional activity. We do not knowingly collect personal information from anyone under 18, and we do not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act. If you believe a minor has provided us information, contact [email protected] and we will delete it.
11. SECURITY
We maintain administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you and applicable regulators as required by law.
12. THIRD-PARTY LINKS AND PLATFORMS
The Services link to and integrate with third-party platforms including podcast hosts, social networks, payment processors, and community tools. Their handling of your information is governed by their own privacy policies, not this one.
13. CHANGES TO THIS POLICY
We may update this Policy. Material changes will be posted here with a revised Effective Date and, where required, communicated to you directly. Your continued use of the Services after the Effective Date constitutes acceptance.
